Please read these Terms of Use (these "Terms") carefully as they govern your use of (which includes access to) SaphireDent’s personalized services for, including all of our websites, software applications, consultations and operations that incorporate or link to these Terms (collectively, the "SaphireDent Clinic Services") and any other material or services that is made possible through the SaphireDent Clinic. By using our website or services, you agree to our Terms and Privacy Policy. You further agree that you are at least 18 years of age and are not otherwise prevented from entering into a binding legal agreement.

SAPHIREDENT AGIZ VE DIS SAGLIGI LIMITED SIRKETI is a for-profit medical service provider and treatment company headquartered in İstanbul / TURKEY. The terms “us”, “we”, “our”, and “SaphireDent” refer to SAPHIREDENT AGIZ VE DIS SAGLIGI LIMITED SIRKETI The terms “site” & “website” refer to www.saphiredent.com and connected sites.

SaphireDent is a medical service provider, and does provide advice or opinion of a medical nature (including with respect to any likely results, risks, or side effects). The purpose of SaphireDent is to create an avenue for potential clients to view and obtain information about contracted hospitals and specific medical facilities in Turkey including its own clinic with contracted medical doctors, make hotel arrangements & transportation assistance in Turkey, and assist in connecting clients to doctors that clients have selected by scheduling appointments and facilitating transport to various medical facilities in Turkey either by itself or in-network providers.

Our call center agents and websites provide clients and potential clients the opportunity to research medical procedures, advice, treatment, diagnosis, medical doctors, whole transportation procedures and cost to make decisions about the care they may choose to receive. SaphireDent call center agents are not medical professionals and do not attempt to provide professional medical advice about any medical procedures and treatments. We hold no responsibility or liability of any kind for medical advice and procedures conducted by customer service agents. All medical services rendered are the responsibility of the medical service facility that provides the services and liable for fault, and are governed solely by the terms and conditions of the medical facilities you may enter.

Although we attempt to provide accurate information, your use of any information about medical, dental, cosmetic, non-invasive or any other procedures provided by SaphireDent or its affiliates verbally, electronically, through our website or every kind of interactions with call center agents is solely at your own risk. SaphireDent makes no representations regarding the completeness or correctness of the information presented, and shall not have any liability or responsibility for any incorrect, incomplete or out of date information that may be provided. All site visitors assume the inherent risks involved with any medical procedures.

Prices provided by agents are may change due to complications that may occur during the operations. You acknowledge that prices are subject to significant differences based on a variety of factors. Every medical case is unique and may require additional services to be determined by the medical facility administrators and doctors involved. SaphireDent will not be held liable for any additional medical costs associated with additional services rendered under any circumstances. Medical professionals may make changes at any moment in order to protect the patient from harm. We are not responsible for any changes or alterations in medical treatment made by medical professionals.

In cases where the health professional from whom the current diagnosis and consultation was taken will not work further for any reason, another medical professional with the same standards is recommended to the patient, but the patient's right to refuse. In this case, no right to claim any compensation about cancelling or change of the medical professional from SaphireDent will arise.

SaphireDent does not provide air travel booking services to and from Turkey. Travel plans may require modifications that can alter the cost of travel and hotel accommodations. SaphireDent will not be held responsible for cost increases associated with air travel. Any and all fees associated with airline booking, rebooking, cancellations, extensions, and delays will be at the expense of the client. Clients are subject to the terms and conditions of airline companies while during travel duration periods. If for the Clients traveling to Turkey requires airline connections in foreign or domestic cities and countries. SaphireDent will not be held responsible or liable for any losses, damages, delays, and cancellations incurred in these locations.

SaphireDent offers hotel and accommodation services in some of its packages. SaphireDent will not be held responsible or held liable for any changes or price increases resulting from changes to prior agreed upon travel dates and hotel booking dates. Should travel and hotel dates require changes, SaphireDent will attempt to make necessary accommodations on behalf of its clients. If the package includes accommodations, all fees and costs associated with booking and rebooking changes, extensions, cancellations, and delays are the responsibility of the SaphireDent, otherwise clients will be responsible for the costs. Clients may also be responsible for additional booking, rebooking, and cancellation fees from SaphireDent. SaphireDent and its employees are not responsible or liable for any incidents involving its clients while residing at any of the hotel facilities or staying in Turkey unless they are at fault. Clients enter country and these facilities at their own risk.

SaphireDent will take necessary precautions to protect the privacy of its clients. In some instances, the electronic transfer of information via the internet may be out of our control. We will not be responsible for information that has been hacked or stolen electronically. You are responsible for the content you send using our website and the resulting consequences. Unless otherwise stated, it is considered that all content shared with SaphireDent is allowed to be used. All clients must be 18 years of age or older or legally permitted by their legal guardians. Clients may be required to show proof of age or written consent of their legal guardian before using the SaphireDent services or before engaging in communication with any SaphireDent employees.

Other than as expressly provided in these Terms and Conditions, SaphireDent does not make any promises or guarantees about the services rendered by us, and will not be held liable for any indirectly damages resulting from the use of our services. By using our website or services, you understand and agree that you assume all risks, whether direct or indirect, that may arise from the use of our website or any of our services or any services provided by us or our affiliates. SaphireDent and its subsidiaries, including its employees, management, partners and agents, cannot be held responsible for any medical procedure (including but not limited to the consequences of any medical procedure or the cancellation or adjustment of any medical procedure) performed by a facility specified on the website or by SaphireDent itself or any of its affiliates.

All individuals enter into an agreement with any medical facility at their own risk and fall under the terms and conditions of any medical facility they so choose to enter. Users agree that SaphireDent will resolve all disputes, refunds and reimbursements with the medical facilities where procedures are performed, and make such payments to SaphireDent. SaphireDent will not be responsible under any circumstances, to the fullest extent permitted under applicable laws, to repay or reimburse you or any users of its services or website.

These Terms and Conditions and the relationship of the parties shall be governed by the laws of Turkey, without giving effect to any principles of conflicts of law. Each client agrees that any action at law or in equity arising out of or relating to these Terms and Conditions or any services provided by SaphireDent shall be filed only in the İstanbul Bakırköy Court, and each client further consents and submits to the personal and exclusive jurisdiction and venue of such courts for the purposes of litigating any such action. Each client further agrees to accept any service of process (such as a summons and a complaint) by certified mail with return-receipt requested, mailed to the last mailing address that you provided to SaphireDent. Service will be deemed complete ten (10) days after mailing. It is each client’s responsibility to update his or her address.

These Terms and Conditions may be modified, altered or amended from time to time by SaphireDent. Any changes to these Terms and Conditions will be considered agreed to by the client upon continued use of the website or any services provided by SaphireDent.

In the event any paragraph and/or portion of these Terms and Conditions is found to be invalid or unenforceable, the remaining portions of these Terms and Conditions shall remain in full force and effect.
